PROMOTION DESCRIPTION: The “Big Wish 175” Sweepstakes 2009 (the “Sweepstakes” or the “Promotion”) begins at 12:01 AM Eastern Time (ET) on Friday, June 12, 2009, and ends at 11:59 PM ET on Tuesday, December 15, 2009 (the “Promotion Period”).

Participants are invited to create their own personal wish, one that they would like to have come true in 2009, and enter it into the Sweepstakes. All “wishes” received will be set ablaze in a special ceremony on New Year’s Eve 2009, at the site of the Sister Cities Bridge, downtown Rochester, under the supervision of the City of Rochester Fire Department.

ELIGIBILITY: Entrants must be a legal resident of the Counties of Monroe, Genesee, Livingston, Ontario, Wayne and Yates in New York State during the Promotion Period. No age restrictions apply. Children 5 years of age or younger may only enter by mail or paper ballot.

By participating in the Sweepstakes, each participant and the parent or legal guardian of, if participant is not of the legal age of majority in New York State (the "Minor"), unconditionally accepts and agrees by submitting an entry to comply with and abide by these Official Rules and the decisions of the City of Rochester (the "Sponsor"), which shall be final and binding in all respects.

Note: Any prize won by an entrant under the age of 21 must be accepted by the Winner’s parent or legal guardian.

Persons in any of the following categories are NOT eligible to participate or win prizes in the Sweepstakes: (a) persons who are directors, officers, employees or agents of Sponsor, or any parent, subsidiary, affiliate, service agency, independent contractor or prize supplier of any of the above organizations; (b) individuals engaged in the development, production or distribution of materials for this Sweepstakes; and (c) persons who are immediate family members (defined as spouse or biological or step- mother, father, sister, brother, daughter, or son and each of their respective spouses, whether actual or purported) of any person in any of the preceding categories, regardless of where they live, and/or individuals who reside in the same household, whether related or not, as any person in any of the preceding categories. Void where prohibited.

HOW TO ENTER: There are three (3) ways to enter.

Method #1 Online: Visit www.bigwishrochester175.com (the “Website”) and go to the "Enter for a Chance to Win” section. Once on the Sweepstakes page entrants will be prompted to enter their date of birth and Big Wish.

1. IF YOU ARE 13 YEARS OF AGE OR OLDER, you will be prompted to enter your name, complete address, phone number and email address. Check the box indicating that you agree to the Official Rules. Click "Submit" to complete your entry ("Sweepstakes Entry").
2. IF YOU ARE UNDER 13 YEARS OF AGE AND OLDER THAN 5 YEARS OF AGE, you will be prompted to provide a nickname* for yourself and your parent or legal guardian's email address. DO NOT PROVIDE YOUR OWN EMAIL ADDRESS. IF YOU ENTER YOUR OWN, YOUR ENTRY WILL BE INVALID. Enter your wish and submit to complete your entry ("Sweepstakes Entry"). If you are a minor in your jurisdiction of residence, you are advised to obtain permission of your parent/legal guardian before entering Sweepstakes or providing any information on-line.
3. One (1) entry per person, per week is allowed. Any person who uses any device or artifice to attempt to enter the Sweepstakes multiple times in violation of the entry limitation will be disqualified. All entries become the property of the Sponsor.

*In keeping with COPPA (the Children’s Online Privacy Protection Act) regulations, children under the age of thirteen (13) may only submit their personal contact information by mail or ballot.

Method #2 By Ballot: Complete an Official Entry Form, which can be obtained at the Rochester City Hall and City of Rochester designated locations. Complete the Entry Form and deposit in the collection box provided.

Method #3 By Mail: Mail your entry, including your full name, home address, phone number, email address, age and your Big Wish, to: The City of Rochester “Big Wish 175” Sweepstakes Entry, 625 Panorama Trail, Bldg 2, Suite 100, Rochester, NY 14625.

CHILDREN 5 YEARS OF AGE OR YOUNGER MAY ONLY ENTER BY PAPER BALLOT OR MAIL.

All entries must be received by Tuesday, December 15, 2009. Mechanically reproduced entries will not be accepted. Sponsor not responsible for illegible, damaged, lost, late, misdirected, or postage-due mailed entries, nor for online entries that are not received due to technical/transmission difficulties beyond their reasonable control. Entries submitted by ballot may only be deposited during the operating hours of that location. It is the entrants' sole responsibility to notify the Sponsor of any changes to his/her address, phone number or email address. To do so for this program, send a letter with your name, original address, phone number, and email address and the new address, phone number, and/or email address (or, if under 13 years old and you entered online, send only your nickname, parent/legal guardian original email address and the parent/legal guardian new email address) to: The City of Rochester “Big Wish 175” Sweepstakes Address Change, PO Box 25497, Rochester, NY 14625.

In fairness to all participants, only one (1) entry, per person, per week, by any of the aforementioned means will be allowed. Any additional entries will be void and considered ineligible.

DRAWING: One Hundred and Seventy-Five (175) winners will be selected in a random drawing on or about December 16, 2009 under the supervision of the US Sweepstakes & Fulfillment Co., an independent agent of the Sponsor, whose decisions will be considered final on all matters relating to this Sweepstakes.

PRIZES:

• First Prize: One (1) First Prize of a 2010 Chevrolet Traverse AWD 2LT. Approximate Retail Value ("ARV") of First Prize: $38,740.
• Second through One Hundred and Seventy-Fifth Prizes: Prizes to be determined and will be associated with products and businesses representing the City of Rochester and County of Monroe.

WINNER NOTIFICATION: Winners will be notified by phone and/or email initially, and confirmed in writing, by email, or by other form of home delivery, and will be required to sign and return, within five (5) days of notification, an Affidavit of Eligibility, a Liability Waiver, and where allowable, a Publicity Release. If the potential winner is under 13 years of age, an email will be sent to the potential winner's parent or legal guardian (at the email address provided by potential winner when entering) notifying parent/legal guardian of child's potential winner status and containing a printable version of the Affidavit of Eligibility, a Liability Waiver, and where allowable, a Publicity Release. Sponsor is not responsible for any change in entrant's email, mailing address and/or telephone number.

The First Prize will be awarded within approximately 90 days after the winner is verified, through an authorized Chevrolet dealership nearest the winner’s home. Vehicle will be delivered with standard equipment, as designated by Sponsor; any upgrades and options are at the sole expense of the Winner. Color, package, factory options, and other prize specifics to be determined by Sponsor and are subject to availability. Winner will be responsible for all optional equipment, title, license, insurance and registration fees required in claiming the First Prize vehicle, applicable taxes as well as all other expenses relating to the receipt and use of First Prize vehicle, including any travel and transportation costs associated with collecting the vehicle.

All other costs not specifically stated herein as being awarded are the responsibility of the Winner. First Prize Winner must have proof of a valid U.S. driver’s license from their state or place of residence in the United States and proof of driver's insurance to take delivery of vehicle; failure to show same may result in prize forfeiture and selection of an alternate winner.

If a potential winner does not respond within the designated time period, or if any prize notification is returned as undeliverable, it will result in disqualification, and the prize may be awarded to an alternate winner in a separate random drawing. Prizes are non-assignable or transferable to another individual, except at the Sponsor’s sole discretion.

Winner is responsible for all taxes, if applicable. Entry and acceptance of the prize constitutes permission for Sponsor or their agent(s) to use winner's name, prize won, hometown and likeness for online posting and promotional purposes, without further compensation, except where prohibited by law. Unclaimed prizes may not be awarded.

If a minor wins a prize, the prize will be awarded to the winner's parent or legal guardian in the name of the winner. Each prizewinner or their parent/legal guardian shall be responsible solely for all federal, state and/or local taxes. A potential winner of a prize may not transfer his or her prize prior to being awarded. No cash alternative or substitution of prizes will be allowed except that, at the sole discretion of the Sponsor, the Sponsor may substitute a prize of equal or greater approximate retail value if the prize described in these Official Rules is unavailable for any reason. Any difference between the stated and actual value of the prize will not be awarded. All details and other restrictions of prizes not specified in these Official Rules will be determined solely by Sponsor. Limit one (1) prize per person/family/household/email address. All prizes are awarded "as is" with no at-law or implied warranties whatsoever. Any prizes that are not duly claimed in accordance with these Official Rules will not be awarded.

ODDS: Odds of winning are based upon the total number of eligible entries received.

GENERAL CONDITIONS: On behalf of himself/herself and child, parent/legal guardian of participant agrees that Sponsor, its parent company and its franchisees, affiliates, subsidiaries, local corporate advertising cooperatives, advertising/promotion agencies, and each of their respective directors, officers, employees, representatives and agents (collectively, the "Promotion Entities") shall not be responsible or liable for any losses, damages or injuries of any kind resulting from participation in the Sweepstakes or from acceptance, receipt, possession and/or use or misuse of a prize. Sponsor and the Promotion Entities assume no responsibility for any damage to an entrant's computer or telephone system that is directly or indirectly caused by accessing the Website or otherwise participating in the Sweepstakes, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, dropped or delayed computer transmissions or network connections that are human or technical in nature. The Website's database clock will be the official timekeeper for this Sweepstakes.

Once submitted, entries become the property of the Sponsor. NOTE: Internet entry must be made by the entrant or entrant's parent/legal guardian, only at the Website. In the event of a dispute as to the identity of an online entrant, the online entry in question will be deemed submitted by the authorized account holder of the e-mail account for the e-mail address provided at the time of registration. The authorized account holder shall be the natural person to whom the applicable e-mail address has been assigned by the Internet access provider, service provider, or other online organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. No mechanically reproduced, illegal, forged, software generated or other automated entries will be accepted. All legal responsibilities of a minor under these Official Rules will be assumed by a parent/legal guardian. By participating in this promotion, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and the Promotion Entities. This sweepstakes is subject to all applicable federal, state and local laws and regulations.

By entering the Sweepstakes, all participants agree: (a) to be bound by these Official Rules and the decisions of the Sweepstakes Entities, and their respective Privacy Policies; and (b) to be contacted by the Sweepstakes Entities and/or their promotional partner(s) via e-mail.

Sweepstakes Entities’ failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Entries become the sole property of the Sponsor and will not be acknowledged or returned. Sweepstakes Entities reserve the right at their sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Sweepstakes website; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other participant or person.

CAUTION: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OR CRIMINAL OR CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY SUCH PARTICIPANT AND SEEK DAMAGES FROM ANY SUCH PARTICIPANT OR ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

LIMITATIONS OF LIABILITY: Sweepstakes Entities are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with, or utilized in, this Sweepstakes, or by any technical failure or human error or any other causes beyond the control of Sweepstakes Entities which may occur in the processing and/or transmissions in the Sweepstakes.

Sweepstakes Entities assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or authorized access to, or alteration of, entries.

Sweepstakes Entities are not responsible for any problems or technical malfunction of any computer on-line systems, servers or providers, computer equipment, software, failure of e-mail due to technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any other person’s computer related to, or resulting from, participating or downloading materials associated with this Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including, without limitation, infection by computer virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sweepstakes Entities which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sweepstakes Entities reserve the right at their sole discretion to cancel, terminate, modify or suspend the Sweepstakes, and select a winner from all entries received up to the time of termination.

DISPUTES: Each participant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court of the Sponsor’s choosing (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys fees and (3) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to, claim punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and the Sponsor in connection with this Sweepstakes shall be governed by, and construed in accordance with the laws of the State of New York.
